of a disabled or incapacitated relative.
Although it seldom happens, advance
preparation can simplify and alleviate many otherwise complex legal issues.
The sooner these issues are resolved, the better for the care givers as well
as for those in need of help.
For example, if there is no durable power
of attorney or living trust (with assets), then the state probate court will
assume responsibility for oversight of the disabled person's financial
affairs. In many cases, even a spouse can't make financial or legal decisions
on behalf of an incapacitated spouse with respect to any property that is not
jointly owned or held in a living trust.
